Code of Ethics

Honesty / Expertise / Cooperation

PREAMBLE

The code of ethics represents a summary of basic values, principles, rules of conduct, rights and obligations of representatives of the Real estate agency DESIRE REAL, Ltd and DESIRE REALITY,  Ltd. hereinafter referred to as "Real Estate Agency or REA".

I. COMPANY

(1) A Real Estate Agency is a company operating as Real Estate broker.

(2) The Representative of the Real Estate Agency, also referred to as "Agent", is an authorized person to perform the activities agreed upon according to the Agreement on the company's commercial representation.

II. BASIC PRINCIPLES

Article 1
General principles and obligations of the member

(1) When performing activities, the Agent acts honestly, in accordance with good morals and honest business dealings. The Agent always speaks on his own name or in company name than the Agent represents. It always provides services professionally, conscientiously, and responsibly.

(2) The Agent must always behave in such a way as to secure the trust of the client and those with whom he comes into contact.

(3) The Agent is an expert in the field in which he works and constantly improves his expertise. The Agent is obliged to professional retraining by experts at least once every 36 months, or by professionals from unions (Real Estate Union of the Slovak Republic, NARKS...). The Agent is obliged to obtain a certificate of professional competence in the field of reality after 24 months of working in the RK. The certification is carried out by the Real Estate Union of the Slovak Republic, or NARKS.

(4) When providing services, the Agent always pays attention to the fulfilment of clients' goals and prioritizes their interests over their own interests.

(5) The Agent provides services in areas that are professionally capable and for which authorization should be carried out. In matters that exceed his professional qualifications, he undertakes to consult the details of the solution of the business case with an expert or to invite an expert directly to solve the case.

(6) The Agent always acts and acts in such a way that the good name of REA is preserved.

(7) When performing activities, the Agent always behaves in such a way that his actions do not enable another Agent, or members of the union and association.

(8) The representative of the REA is obliged to respect the Generally legal regulations of the Slovak Republic, statutes, and internal regulations.

Article 2
Obligations of the Agent in relation to clients

(1) The Agent makes every effort to provide first-class services to clients with his expertise and approach.

(2) The Agent provides information that is true, accurate and current.

(3) The Agent must maintain strict discretion when carrying out the activity. He must respect professionally, he must not disclose confidential information that he obtained from his client, cooperating colleague or member of union, partner, or employer, both current and past, or use such information to his detriment without express consent.

(4) The Agent applies a polite, correct, and impartial approach to all clients. In a conflict situation, he looks for the most suitable solution for the client(s) through reconciliation.

(5) The Agent is also obliged to:

a) to inform the client about the range of services it provides and about the commission associated with these services,

b) continuously communicate with the client about the development of the case entrusted to him,

c) without undue delay, to notify the client of all important cases and to require the client, with the essential documents, which he receives or receives in connection with his business partner,

d) at a reasonable time answer to the respective client,

e) to handle the documents, and things entrusted to him with care, to protect them from impairment, loss, theft or destruction and to take all necessary measures to protect them from unauthorized persons,

f) to protect the client's personal data from misuse, loss, or theft.

(6) In the event that the Agent accepts an advance for his downpayment (reward) from the client, he is obliged to use it only for the implementation of the business case in connection with which the advance for remuneration was provided.

(7) In the event that the Agent receives funds from the client that are not in the nature of compensation for already provided advice, intermediary services or delivered goods, he is obliged to keep these funds, not to use them contrary to the adopted purpose and to keep them separate from of his property. After the implementation of each business case, the Agent is obliged to properly account for his obligation.

(8) If the client submits a Complaint against the service provided or the payment, the Agent is obliged to comply with it and handle it within 30 days at the latest. If the complaint is justified, the Agent is obliged to order a remedy, provide removal, or provide an adequate discount on the price of the services. If the complaint is unfounded, the Agent is obliged to announce the reasons for evaluating the complaint as unfounded.

III. COOPERATION BETWEEN AGENTS AND ASSOCIATION MEMBERS

(1) Agents and other Members of the Real Estate Union, or NARKS, treat each other correctly and politely under all circumstances.

(2) Agents try to make every effort to prevent possible disagreements, conflicts or misunderstandings between them, their clients or their representatives.

(3) Each Agent is obliged to refrain from any actions that could direct or result in the transfer of the client to another Agents or a Union´s member the aim of excluding him from the business case, or to discourage the client from cooperating with another Agent of REA.

IV. OTHER AND FINAL PROVISIONS

(1) Violation of internal agreements and rules according to the Agreement on commercial representation and/or the Code of Ethics creates the right of DESIRE REAL, Ltd and DESIRE REALITY, Ltd. for disciplinary proceedings and sanctioning of the Agent.

(2) The Code of Ethics is an Internal regulation of the REA, relevant for all Agents of REA. REA reserves the right to change, supplement or cancel this code by issuing a new code or internal regulations, mainly as a result of changes in the legislative, economic, business, technical environment or internal needs of the company. REA is authorized to implement individual parts of this code in the form of internal regulations, which are directives and resolutions. The new wording of the code or internal regulation does not have retroactive effect.

(3) This Code of Ethics becomes valid and effective on 1 January 2014.
